Citizenship And Naturalization

Immigration law is filled with complex aspects that need to be carefully addressed. Application for U.S. citizenship can be intimidating for many applicants. If you are thinking of becoming a naturalized U.S. Citizen, our attorney at Khairul Bashar Law can assist you in this process.

Citizenship By Naturalization

Naturalization is a route that permits foreign-born individuals to obtain citizenship in the United States. Once approved U.S. citizenship, foreign-born individuals are permitted the right to vote, the right to federal government jobs, the right to apply for resident status for immediate family members and the freely travel with an U.S. passport which provides entry without a visa into many countries. A key benefit a naturalization once granted U.S. citizenship is the ability to apply for an immediate family member through a faster petitioning process. There are certain requirements before submitting an application for naturalization.

Eligibility of U.S Citizenship

Applicant has been a lawful permanent resident for five years (or three years for spouses of U.S. Applicant is 18 years or older, is of good moral character, can speak, read, and write English, must pass a test on U.S. history and government, was physically present in the U.S. at least half the requisite time, has maintained lawful permanent residence continuously and swears loyalty to the U.S. by taking an oath of allegiance.

Exemptions from the naturalization test

An applicant who is above age 50 at the time of filing the N-400 application will not be required to take the English test, if he or she has lived here as a legal resident for a 20-year period. This also applies to seniors above age 55 who have spent more than 15 years in America as legal residents. Applicants above age 65, who have spent more than 20 years in the U.S., can request an exemption from the English test. These seniors will be allowed to take an easier version of the civics test. They can take the civics test in their native languages, using an interpreter.

Exception from the naturalization test:

Applicants who have a physical or a mental impairment will become eligible for an exception to the English and the civics requirements if they establish, by submitting Medical Certification for Disability Exceptions, completed by licensed medical doctors, that they are unable to comply with the requirements.
